Accessory dwelling unit workaround to be explored by Elk Grove

At last night's meeting, the Elk Grove City Council decided to explore a workaround allowing for more local control on California's new accessory dwelling unit law.
With the support of two colleagues, District 2 Councilmember Pat Hume said he would like to see if the city could examine the law, which offers homeowners more flexibility on where accessory dwelling units can be located. The law, Assembly Bill 68, was signed into law in 2019 and became effective January 1, 2021.
In his comments, Hume said he met with constituents in an unidentified neighborhood who live in so-called RD-5 dwellings - five housing units per acre - and claimed the new standard effectively double density in Elk Grove residential neighborhoods.
"It completely changes the entire nature of that neighborhood," Hume said.
The law, sponsored by California Assemblymember Phil Ting (D - San Franciso), is designed to address California's affordable housing shortage. Elk Grove's representative in the Assembly, Democrat Jim Cooper, voted for the legislation.
Supporting Hume's request was Mayor Bobbie Singh-Allen and District 1 City Councilmember Darren Suen. The city staff will provide a report at a future meeting, but short of filing a lawsuit seeking to reverse the legislation, it is unlikely a defensible workaround will be identified given the law was passed to prevent restrictive local regulations.

In Elk Grove, there's a lot of bright red lip service given to affordable housing. But when the rubber meets the road, Elk Grove leaders put on their elitist caps and say Not In Our City.
City Attorney Jonathan "Settlement" Hobbs has a good record of avoiding litigation, so I'm sure his crack team at Kronick, Moscovitch will find a loophole in the State law, or suck our budget trying!
