Civil suit filed against prominent Elk Grove developer, small business plaintiff seeks to collect unpaid bills




A real estate developer who has had significant political influence in Elk Grove over the last decade has been sued in Sacramento Superior Court.

That developer is Kamilos LLC, and its subsidiary entity, the Souza Elk Grove LLC. The plaintiff in the lawsuit is Kenneth Allred, doing business as Allread Land Consulting.

According to the filing recorded on March 10, 2023, Allred is seeking to collect past dues fees of $74.579. 

Documents accompanying the lawsuit show a memorandum between Kamilos and Allread dated February 14, 2019. That document is titled "Land Development Services Engagement Authorization Souza Dairy Project."

The document describes the work product for Allred to include "provide land planning, civil engineering, and construction phase consultation Services for the various land development approvals needed for the development of the Souza Dairy Project."

Allred's attorney, Sacramento-based Downey Brand, sent a "notice of default" letter to Kamilos LLC's principal Gerry Kamilos on December 20, 2022. That letter references the February 2019 agreement and another dated September 17, 2012. 

The total amount billed to Kamilos by Allread was $626,771. A case management conference is scheduled for January 19, 2024.

The Souza Dairy Project is part of Elk Grove's Southeast Policy Area (SEPA). The Souza Dairy Project portion of the SEPA is 375 acres zoned primarily residential.

Last year Kamillos donated $12,500 to Elk Grove's Yes on Measure E campaign. That measure increased Elk Grove sales taxes by one percent and was favored by the Elk Grove City Council and the city's executive management team.
