The Commission on Judicial Performance announced it had instituted formal proceedings to inquire into matters concerning Judge Gary G. Kreep, a judge of the San Diego County Superior Court of California.

Kreep, an advocate of the discredited "birther" movement, was elected to his position on the San Diego Superior Court in 2012. Since his election, Kreep has faced several imbroglios regarding comments from the bench.

On October 14 the Commission on Judicial Performance announced that an investigation was launched on Kreep for ethics violations. The allegations center on a fundraising letter Kreep sent in 2012 questioning President Obama's citizenship.

Kreep has also been accused of making demeaning and racially insensitive remarks toward defendants and attorneys from the bench.

The hearing has been scheduled to begin on Monday, February 6, 2017, at 9 a.m. in the courtroom of the California Court of Appeal, Fourth Appellate District, 750 B Street, in San Diego, California. The hearing will be open to the public.
