DUI charges against admitted drunk driving Elk Grove City Councilmember Sergio Robles disappear
For a first offense, violating this code is a misdemeanor, and the penalties can include up to five years' probation, 96 hours to six months in jail, and/or up to $2,000 in fines.
A review of the public information case system showed that Robles' arrest record, 23MI009521 (see documents below), is no longer accessible. A Sacramento Superior Court case record counter clerk said that when a case is no longer available for public view, it usually means the charges have been dismissed.
As Elk Grove News reported one year ago, an examination of the file revealed Robles was eligible for a Military Diversion Program. On November 3, 2023 Robles was enrolled in the program.
The file included a sheet indicating Robles attended at least eight 12-step meetings at Midtown Solutions, with the last recorded session examined last year on April 5, 2024. During the 2024 review of Robles' file, a sealed medical record was also observed.
Active and former members of the U.S. Armed Services are eligible for the diversion program for those committing misdemeanors and certain felonies. Robles is a member of the California Army National Guard.
Participants must document one or more of the following conditions that resulted from their military experience:
- Post-Traumatic Stress Disorder (PTSD
- Traumatic Brain Injury (TBI)
- Military sexual trauma
- Substance abuse
- Other mental health problems
It is not known what condition was applied to Robles in the dismissal of the drunk driving charges. Robles did not respond to an email request seeking comment on the disposition of the case.
Before his 2023 DUI arrest, Robles regularly shared videos of himself and others consuming alcohol on social media. On the evening preceding his arrest, a social media video showed Robles in an obvious state of impairment (See video below).
Since then, Robles has scrubbed drinking and partying videos and images from his social media. Although Robles has not discussed the case publicly, should he seek another term in 2026, it may confront him.
