The Elk Grove City Council voted to place strict limits on where medical marijuana can be grown within the city at tonight's regular meeting.
In a 3-2 vote vote, council members decided to limit any medical marijuana growing operation in Elk Grove to indoor cultivation that either can take place in a residence or a secured out-structure. Mayor Jim Cooper, and council members Gary Davis and Pat Hume voted in favor and Steve Detrick and Sophia Scherman voted against the motion.
Previous to this there was no specific ordinance addressing how medical marijuana could be cultivated.
The ordinance was developed following the complaints of several residents in one of Elk Grove's rural-agricultural areas on the city's east side. Among the complaints voiced last summer were the overwhelming odor of the plants as they matured and the potential criminal element that could be attracted to the growing operations.
With the passing of the ordinance, those medically qualified to grow marijuana plants will now be limited to 50 square feet of indoor residential cultivation or a 12 square foot secured out-structure. Any grower will also be required to apply for a two-year permit with the Elk Grove Police Chief, be subjected to inspections with a 24-hour notice and banned from cultivation within 1,000 feet of a schools,child care centers and public parks.
During deliberations Council Member Sophia Scherman said she would not support any cultivation within the city. While council members Gary Davis and Steve Detrick noted they too would like to ban cultivation, city attorney Jonathon Hobbs said it was not currently clear if an outright ban is legal.
"But this ordinance gives the city a tool," Hobbs noted.

Darn it! Now the city will just be pointing my home out with all the restrictions, home visits, having to grow in my garage that everyone can see when I park my car or in the living/dining room. Not only that, but the grandkids can't even visit since they're underage. That's not even thinking about those nosy neighbors spreading the word. Seems as though the sick can't even have a little peace during those tough times and maybe their last days.
This is ridiculous! What does inspection mean? My home, my bedroom, my nightstand drawer, what kind of meds I do or do not take? We are one of those couples with no children that are licensed to grow for a GOOD medical reason. We grow our legal limit, and you would never know they are here if you did not climb my fence to look for them! I don't especially care for the birthday parties that my neighbor has that include 30 to 50 people 3-5 times a year that are loud and take up our whole court, but it's all part of being a good neighbor! WE AREN'T BOTHERING ANYONE! Oh and by the way how much is the permit going to cost? I bet they are going to make sure that's cost prohibitive too! Please, there is real crime out there that needs attention not law abiding people minding their own business!!!
