An Elk Grove resident has filed a lawsuit after claiming a K9 officer bit them near their residence.
Filed in Sacramento Superior Court on April 28, plaintiff Scotty Christian claims on April 16, 2022, a canine officer controlled by Elk Grove Police Officer Jason Miller attacked him near his Elk Grove residence.
The filing says the plaintiff "was legally on the public sidewalk adjacent to his residence located at 9301 Starfish Way, Elk Grove, California 95758 when without warning, the subject dog was redirected by Defendants, JASON MILLER, ELK GROVE POLICE DEPARTMENT, CITY OF ELK GROVE thereby charging at Plaintiff. The dog then bit Plaintiff SCOTTY CHRISTIAN's left leg, causing injury and damages."
Following the biting incident, Christian filed a claim against the city for injuries on October 3, 2022, that was denied on November 9. The lawsuit asserts, "Defendants negligently entrusted, managed, maintained, the dog so as to cause the subject incident and the resulting injuries and damages to Plaintiff."
The lawsuit did not explain why the police officer was near Christian's residence or the K9 was "redirected." Christian's attorney, Justin Gingery of the Roseville-based Gingery, Hammer & Schneiderman, did not return a call seeking comment on the incident, and the City of Elk Grove and Elk Grove Police Department does not comment on pending litigation.
