Elk Grove man sentenced in 2018 domestic violence, child sexual assault case


 

An Elk Grove man who plead guilt  to nine charges of child sexual assault and found guilty of domstic violence causing great bodily injury, assault with a shotgun and assault with a knife was sentenced yesterday in Sacramento Superior Court. 

Judge Steve White sentenced David Capps to 39 years in state prison. On March 24, 2022, Capps plead guilty to nine counts of child sexual assault and a jury convicted him on March 28, 2022, of all remaining charges of domestic violence causing great bodily injury, assault with a shotgun and assault with a knife.

On August 19, 2018, Elk Grove Police officers responded to a call and found Capps and the victim at the scene. Officers learned that Capps held a shotgun to the victim’s head and told her it was loaded and threatened a knife to the victim’s throat and threatened to kill her. 

The victim stated that Capps had strangled her to the point of near unconsciousness. Doctors later diagnosed the victim as having suffered a fractured larynx as a result of the strangulation. 

During the investigation, detectives discovered that Capps sexually assaulted a child when she was 7 to 11 years old.
